This is an English translation provided for convenience. The Polish version is the binding one.
§1. General
- These terms govern the use of the website mshr.pl (“the Website”) and the Android app Gilded Gameroom (“the App”). They are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
- The service provider is Szymon Grzybek, a sole trader operating as Little Mushroom Szymon Grzybek, ul. Kingi 58J, 41-711 Ruda Śląska, Poland, tax ID (NIP) 6412452105, REGON 369323390, registered in the Polish Central Register and Information on Economic Activity (CEIDG) (“the Provider”).
- Contact: email hello@mshr.pl, phone +48 721 713 767, postal address as above.
- These terms are available free of charge on the Website in a form that can be downloaded, saved and printed.
§2. Definitions
- User — anyone using the Website or the App.
- Consumer — a User who is a consumer within the meaning of Article 221 of the Polish Civil Code.
- Full version — digital content that unlocks every game in the App, bought once through Google Play.
§3. Using the Website
- Through the Website the Provider makes information about the business available free of charge. The contract for this service is concluded when you open the Website and ends when you leave it.
- You need a device with internet access and an up-to-date web browser. The Website requires no account and stores no cookies or similar data on the User's device.
- Users must not supply unlawful content or interfere with the Website's operation.
- Using the internet carries common risks such as malware or phishing. The Provider never asks for passwords or card details by email.
§4. The Gilded Gameroom app
- The App can be downloaded free of charge from Google Play. Google Play's terms of service also apply to downloads and in-app purchases.
- The App requires an Android device running the version stated on the App's Google Play page. No internet connection is needed to play; one is needed to download the App, buy the Full version and restore it after reinstalling.
- Some games are free. The Full version unlocks the rest. Google Play shows its price, including taxes, before purchase. The Full version is a one-time purchase, not a subscription.
- Purchases are made through Google Play. Google handles payments and purchase confirmations. Google Play's refund rules do not limit the Consumer's rights under the Polish Consumer Rights Act. The Full version is tied to the User's Google account and is restored when the App is reinstalled on the same account.
- The Provider grants the User a non-exclusive, non-transferable licence to use the App for personal purposes, without territorial or time limits. The licence does not cover distributing, reselling or modifying the App, except as permitted by law.
- The Provider may release App updates, including updates that keep it in conformity with the contract.
§5. Right of withdrawal
- A Consumer who concludes a distance contract may withdraw from it within 14 days of its conclusion without giving a reason, subject to point 2. It is enough to send the Provider a statement by email to hello@mshr.pl or in writing to the Provider's address; the model form in Annex 2 to the Polish Consumer Rights Act may be used. Sending the statement before the deadline is enough. The Provider refunds the payment within 14 days of receiving the statement.
- Under Article 38(1)(13) of the Polish Consumer Rights Act of 30 May 2014, the right of withdrawal does not apply to the Full version if supply began with the Consumer's express prior consent, after the Consumer was informed before supply began that they would lose the right of withdrawal and acknowledged this, and the Provider gave the Consumer confirmation of the contract.
- Regardless of the above, Users may request a refund through Google Play under Google Play's rules.
- The Consumer provisions also apply to a natural person concluding a contract directly related to their business, where the contract shows it is not of a professional nature for them.
§6. Complaints
- Complaints about the Website or the App, including lack of conformity of the Full version, can be sent by email to hello@mshr.pl or in writing to the Provider's address.
- A complaint should include contact details and a description of the problem; for the App, also the device model, Android version and, where relevant, the Google Play order number.
- The Provider responds within 14 days of receiving the complaint.
- Any amount due to a Consumer after withdrawal or a price reduction under Chapter 5b of the Polish Consumer Rights Act is refunded without delay and no later than 14 days after the Provider receives the Consumer's statement.
- If the Full version does not conform to the contract, the Consumer has the rights set out in Chapter 5b of the Polish Consumer Rights Act, including the right to have it brought into conformity, to a price reduction or to withdraw from the contract.
§7. Out-of-court dispute resolution
Consumers may use out-of-court complaint and redress procedures, in particular the help of a municipal or district consumer ombudsman or the regional Trade Inspection office. Information is available at prawakonsumenta.uokik.gov.pl (in Polish).
§8. Intellectual property
The content of the Website and the App, including text, graphics, logo and code, is protected by copyright. Use beyond what the law or these terms allow requires the Provider's consent.
§9. Personal data
Personal data processing is described in the Privacy policy. The App collects no personal data.
§10. Final provisions
- The Provider may change these terms only for the following important reasons: a change in law, or a court ruling or authority decision affecting their content; a change in the scope or manner of the services, including new services; a change in the Provider's details. Amended terms are published on the Website at least 14 days before they take effect. A change does not affect rights acquired before it takes effect, including the right to use a purchased Full version.
- These terms are governed by Polish law. This choice of law does not deprive Consumers of the protection of mandatory provisions of the law of their country of habitual residence.
- Nothing in these terms excludes or limits Consumer rights under the law.
